A federal judge will soon decide whether to grant Elon Musk’s Department of Government Efficiency (DOGE) immediate access to sensitive Treasury Department data, including personal information on millions of Americans. Judge Jeannette A. Vargas has instructed both parties to file their arguments by Tuesday. Afterward, she will rule on whether to lift the restrictions placed on Musk’s team. The current ban, imposed by Judge Paul A. Engelmayer, will remain in effect until a hearing scheduled for Friday.
Legal Battle Over Access
The Justice Department claims the ban is unconstitutional and undermines the proper functioning of the Executive Branch. They argue that there is no valid reason to treat political appointees differently from civil servants when overseeing government work. Furthermore, they emphasize that the order interferes with the necessary supervision required by the Constitution. As a result, they are pushing for immediate reversal of the ban.
Lawsuit and Political Pressure
Meanwhile, 19 Democratic attorneys general, led by New York’s Letitia James, have filed a lawsuit. They argue that Musk’s team should not have access to Treasury data. According to them, only civil servants should be allowed to handle sensitive records like Social Security numbers and bank accounts. This lawsuit has added significant political pressure to the ongoing legal battle.
On Sunday, Justice Department lawyers argued that the court’s order was too broad. In fact, they pointed out that it could even prevent Treasury Secretary Scott Bessent from accessing records. They further contend that the ruling interferes with the political accountability essential for proper government oversight.
Musk and Vance Criticize the Ruling
In response, both Elon Musk and Vice President JD Vance have strongly criticized the ruling. Musk, in particular, called the judge’s actions part of a corrupt system. He tweeted, “A corrupt judge protecting corruption. He needs to be impeached NOW!” President Donald Trump also weighed in, stating, “No judge should frankly be allowed to make that kind of decision.”
Security Concerns and Legal Defenses
In contrast, some experts have raised concerns about the security risks associated with Musk’s team accessing Treasury data. They worry that it could jeopardize the privacy of Americans’ personal information.
On the other hand, the attorneys general argue that access to sensitive data should be limited to career Treasury staff. These staff members, who undergo rigorous security clearances, are better equipped to handle such sensitive information.
