The Supreme Court has expressed displeasure over the presence of Yasin Malik, accused of killing four Air Force officers at Srinagar airport station on January 25, 1990 and harboring terrorists in Kashmir. The court reprimanded the Tihar Jail Authority and asked why Yasin Malik was produced in the court without orders. The court also asked why he was brought to the court when the resources for virtual Appearance are available in the jail.
Justice Suryakant and Justice Dipankar recused themselves from the hearing in Yasin Malik’s case. Now this matter has been sent to the Chief Justice. The hearing of the matter has been fixed after 4 weeks.
Earlier, Solicitor General Tushar Mehta also expressed strong objection on behalf of the Central Government on Yasin Malik’s physical appearance in the court. He said that orders have been passed not to bring Yasin Malik out of jail under section 268 of CrPC. Under these circumstances, how did the Tihar Jail administration send Yasin out.
In fact, Yasin Malik had filed an application against not being allowed to present himself in TADA Court of Jammu. In the last previous hearing, the CBI had told the Supreme Court that Yasin Malik should not be allowed to go to Jammu and present himself in the court in view of the security reasons. In fact, the hearing against Yasin Malik in the case of the murder of four Indian Air Force officers is going on in the special CBI court in Jammu. On January 25, 1990, three other Indian Air Force officers, including Squadron Leader Ravi Khanna, were allegedly killed by Yasin Malik and his fellow terrorists at Rawalpora in Srinagar.
