A petition has been filed in the Delhi High court on Tuesday against sealing of Delhi borders for a week by the Aam Aadmi Party-led Delhi government. The plea claims that Delhi government’s order is illogical, irrational and unreasonable as well as violates Articles 14, 19 and 21 of the Constitution.

Petitioner Kushagra Kumar points at Delhi’s status as national capital and existence of centrally-funded hospitals such as AIIMS, claiming that sealing the borders would take away the rights of those working in Delhi and staying in NCR to avail health facilities in Delhi.

The petition says that citizens of neighbouring states of Uttar Pradesh and Haryana too have been deprived of the basic right to access the central hospitals in Delhi, which they can rightfully ingress as Indian citizens. The Constitution allows the right to reside at any place and avail medical facilities anywhere. It claims Delhi government’s order is unconstitutional since it denies the Right to Treatment to Indian citizens staying outside Delhi.
