Lahore High Court Hears Indian Woman’s Petition Of Children Custody

On Friday, Lahore High Court heard a petition from an Indian woman seeking custody of her two minor sons and accusing her Pakistani husband of illegally keeping them. The petitioner, Farzana Begum, appeared before the court with her lawyer, Bushra Qamar, according to Pakistani news outlet Dawn.

Farzana’s lawyer informed the court that her client married a Pakistani man, Yousaf Elahi Mirza, in the United Arab Emirates (UAE) in 2015. The couple had two sons, Ibrahim and Ismail, born in 2016 and 2017, respectively. In 2018, the family moved to Lahore, where Farzana discovered that she was Mirza’s fourth wife.

Farzana’s lawyer claimed that Mirza subjected her to torture and eventually expelled her from the house, taking the children away from her.

 

Children Taken to UAE

During the hearing, Farzana expressed her desire to live with her sons in Pakistan. However, a government law officer revealed that Mirza had taken the minors to the UAE, where he frequently traveled for business.

After considering the arguments, Justice Amjad Rafiq asked Farzana’s counsel to provide legal guidance on how the minors could be brought back to Pakistan from the UAE. The counsel responded that she would present multiple judgments and laws that could facilitate the extradition of the “abducted minors” from the region.

 

The court will resume the hearing next week.
