‘Right to freedom is not absolute,’ says HC rejecting Amritpal Singh’s associate’s bail

Amritpal Singh and his associates are serving sentences in Assam’s Dibrugarh Jail, following their arrest under the National Security Act. Sarabjit Singh Kalsi, a companion of Amritpal, had applied for bail in the Punjab and Haryana High Court, but the plea has been rejected.
Amritpal Singh, the head of the Warriors of the Land of Punjab, is incarcerated in Dibrugarh Jail under the National Security Act along with his associates. Sarabjit Singh Kalsi, one of Amritpal’s associates, had filed a bail application in the Punjab and Haryana High Court, seeking release from custody. However, the High Court dismissed the bail plea, stating that while the Constitution grants everyone the right to security, this right is not absolute.
The court emphasized that rights to freedom could be restricted to safeguard the freedom of others. In such cases, bail might not be granted immediately. The High Court commented on the Constitution of India, stating that it provides the right to security to all citizens, but this right is not absolute.
The bail application of Kalsi, filed in response to an FIR column 2 registered against him at the Ajnala police station regarding the attack on Ajnala police station, was dismissed. Even though he has not been formally arrested in this case, he is currently held in Dibrugarh Jail under the National Security Act.
The application argued that the police should interrogate him regarding the attack on the Ajnala police station. Still, the High Court noted that he was arrested under the National Security Act by the Punjab Police and sent to Dibrugarh Jail. The court cited several reasons behind this decision and ultimately rejected Kalsi’s bail application.
