COMPLICATIONS FOR MAMATA’S OATH TAKING, NO GREEN SIGNAL FROM RAJ BHAVAN

Who will read the oaths of the three newly-elected MLAs including Mamata Banerjee? When will this oath be read? Extreme complexity has been created at the moment with all the issues. And one of the reasons for this complexity is the state- Raj Bhavan conflict.

According to the constitution, ministers and legislators will be sworn in by the governor. It has also been said that if the governor wants, he can hand over the power to administer oaths to the legislators to someone else (which is basically given to the Speaker of the Legislative Assembly). Similarly, on the day the cabinet members of the 17th Legislative Assembly took an oath, Governor Jagdeep Dhanakharai administered the oath. In the case of the rest of the MLAs, on the day the oath was administered in the Assembly, Protem Speaker Subrata Mukherjee and Speaker Biman Bandyopadhyay were only sworn in by Jagdeep Dhankhar.

He then handed over the oath of office to Speaker Biman Banerjee to the rest of the MLAs. Similarly, Biman Banerjee also read the oath. So far so good. But a few days ago a letter came from Raj Bhavan to the Secretariat of the Legislative Assembly. Where it is said, he is revoking the governor’s right to read the oath to the principal. In other words, this time the governor will take the oath of the new MLAs, not the principal.

After that, the assembly again sent a letter to Raj Bhavan informing that any representative of any political party can come and take oath after winning the post of MLA. So this revoked power should be returned to the principal. But the assembly has not yet received any positive response to that letter. In other words, the newly elected MLAs Mamata Banerjee (Bhabanipur), Zakir Hossain (Jangipur), Amirul Islam (Samsherganj) will still be sworn in.

Meanwhile, according to Trinamool sources, preparations are underway to read Mamata Banerjee’s affidavit within the Devi Paksha. It may be that Mamata Banerjee may be sworn in as the MLA of Bhabanipur the day after the mahalaya. Jangipur MLA Zakir Hossain and Samsherganj MLA Amirul Islam can be his companions on this day.

However, this episode is possible only when there is a green signal from the palace. Why not? According to the constitution, the governor is the minister, he has the first power to administer the oath to the legislators. No one else can take the oath unless he is handing it over to someone. In this context, Principal Biman Banerjee said, “The Chief Minister should take oath as MLA in the Assembly. That is necessary. However, the governor has not given any permission yet. ”

Now the question is, does Governor Jagdeep Dhankharai want MLA Mamata Banerjee to take the oath? Is that why he is not giving rights to the assembly. Even so, a precedent will be made as there is not a single instance where the governor is administering oath to any MLA who has won the by-election.
