BBC documentary screening: DU moves to HC against setting aside order debarment of NSUI Secretary

The Delhi University has filed an appeal with the Delhi High Court’s division bench, appealing a single bench judgement that overturned the University’s decision to debar NSUI National Secretary Lokesh Chugh.

On Friday, a panel of Justice Satish Chander Sharma and Justice Nazmi Wajiri requested the response of Lokesh Singh, PhD scholar and national secretary of the Congress’ students wing, to the Delhi University’s appeal. In April, a bench led by Justice Purushaindra Kumar Kaurav overturned the debarment ruling and reinstated the admission.

“The order is set aside. Admission is restored,” said justice Kaurav said. The bench stated that a review of the record will show that the petitioner (Lokesh Singh) was not given a fair hearing and that his position was not considered by the Committee.

The University violated the concept of natural justice, according to the high court. It was also highlighted that the order was issued without any explanation for the decision.
After hearing Attorney General R Venkatramani’s submission, the high court allowed the University the right to take action in accordance with the law.

The bench took note of Senior Advocate Kapil Sibal’s submission on behalf of petitioner Lokesh Chugh. He said that neither the petitioner nor the police detained him at the rally. The FIR did not name him.

It was also claimed that, in response to the show cause notice issued to the petitioner, he came before the university’s committee and justified his actions. His submission did not appear in the sequence.
