The Madras High Court in the case observed and has ordered the Law Secretary of the Tamil Nadu government for taking disciplinary action against C Nagarajan, the Deputy Secretary of Law Department, wherein allegedly misbehaving with the government pleaders inside court room. The bench headed by Justice MS Ramesh in the case observed and has asked the Principal Secretary to place Nagaraj under suspension from service in contemplation of the disciplinary proceedings, while calling the act scandalizing” and “lowering the authority of the Madras High Court.

The court observed that the behaviour of Mr. C. Nagarajan’s amounts to lowering and scandalizing the authority of the Madras High Court, as well as interfering and obstructing with that of the Administration of justice.

In the present case, Nagaraj, who was being assigned the duty for instructing the Government Pleaders, Nagaraj had behaved in an unruly manner on March 23, when the court as per the order was being in recess. It has been alleged by him wherein raising his voice and has used unparliamentary words which are against the Government Pleaders in the presence of Court Officer and other court staff. Therefore, Nagaraj had come to court in connection with a Contempt Petition filed.

The court in its order stated that the court also witnessed the behaviours of other lawyers who were present in court and was recorded in the court CCTV cameras also. Further, it has also been noted by the courts that this behaviour has been continued by Nagaraj even outside the court in the corridors and the same was also witnessed by others including lawyers.

The court stated that further the course of action, as to weather the said court would proceed for criminal contempt, the same would be taken up in the next hearing date on 31.03.2023.
