A Mumbai court, being a special NIA court, has acquitted all seven accused in the 2008 Malegaon blast case, ending a 17-year-long legal fight for one of India’s most politically charged terror cases. The ruling, rendered by Special Judge AK Lahoti, referenced the prosecution’s inability to present tangible evidence to back the charges under the Unlawful Activities (Prevention) Act (UAPA) and the Arms Act.
Malegaon blast, which took place on September 29, 2008, killed six individuals and injured more than 95 in a densely populated Muslim-dominated locality during the month of Ramadan, the holy month of Muslims. The blast, believed to be coordinated just before Hindu Navratri festivities, was regarded as an attempt to fuel communal tensions.
Some of the accused were prominent names, such as BJP former MP Pragya Singh Thakur, Lt Col Prasad Purohit, and Retd Major Ramesh Upadhyay. In 2011, the case was handed over to the National Investigation Agency (NIA) from the Maharashtra ATS. The case was also significant in being the first when suspected Hindu extremists were put on trial for terrorism.
Judge Lahoti ruled that the prosecution was unable to establish that the motorcycle employed in the blast belonged to Thakur. The court also ruled that referring to UAPA here was defective.The
After the verdict, Sadhvi Pragya stated the case had “ruined her life.” She said she was relieved about the acquittal but emphasized the personal cost.
NCP MP Praful Patel has expressed support for the NIA court’s decision to acquit all seven accused in the 2008 Malegaon blast case.
“All condemned what happened in Malegaon, but the court’s verdict in the Malegaon blast should be welcomed by all. We consider citizens of our country as ‘Bharatiya’… Hindus were killed in the Pahalgam attack. We will only call this a terrorist attack,” he told reporters.
