Supreme Court: Plea To Be Heard Challenging Acquittal Of Four Accused On May 17; 2008 Jaipur Serial Bomb Blasts.

The Supreme Court in the case Rajeshvari Devi vs State of Rajasthan observed wherein a special leave petition was moved by some of the victims of the 2008 Jaipur serial bomb blasts challenging the Rajasthan High Court judgement which acquitted four persons who were convicted to death by the trial court in the case.
The bench comprising of Justice AS Oka and Justice Rajesh Bindal in the case observed and has allowed the plea moved by the victim wherein seeking permission to file the petition and posted the same next week which is to be considered along with the special leave petition moved by the State.
The counsel, Senior Advocate Mukul Rohatgi, appearing for the victims stated that the accused persons are still in jail.
Further, the bench headed by Justice Abhay Sreeniwas Oka and Justice Rajesh Bindal in the case observed and has stated that it being not correct as per the law.
The bench in the case also asked that how can an accused be kept in jail after they have been acquitted in the case.
The counsel, Senior Advocate iMukul Rohatogi sought before the court for stay of the order of the High Court, terming it as grossly oerroneus and contrary to settled principles of law of appreciation of evidence.

Therefore, the Attorney General for India R Venkataramani also seek a stay on a paragraph in the order of the High Court which had observations on the State police in a negative light.
The High Court in the case also found serious lapses in the investigation and evidence while acquitting the accused.
Accordingly, the court listed the matter to be next heard on May 17, 2023.
