Supreme Court: Interim Relief Granted To Azam Khan; Stayed The Order Of Trial Court To Submit Voice Sample In 2007 Hate Speech Case

The Supreme Court in the case Mohd Azam Khan v. State of Uttar Pradesh & Anr observed and has put a temporary stay on a order of the trial court order directing him to submit a voice sample in the 2007 hate speech case. The court granted an interim relief to Samajwadi Party leader Azam.
The bench comprising of Justice AS Bopanna and Justice Prashant Kumar Mishra in the case observed wherein the plea is moved by Samajwadi Party (SP) leader Azam Khan against a direction to provide his voice sample in a hate speech case, for comparison with a CD-recorded speech which he delivered during a public gathering in Rampur in August 2007.
The Allahabad High Court in the case observed and has refused to interfere with this direction by a special judge in Uttar Pradesh.
It has been pointed out by the counsel, Senior Advocate Kapil Sibal that despite the filing of a special leave petition by the former legislator, thus, the Special judge declined to postpone the collection of his voice sample due.
It has also been agreed by the Supreme Court to urgently hear the plea moved by him.
The bench in the case observed when the matter was taken up and has promptly issued notice in the petition and gave the legislator protection against having to submit his voice sample in the meantime-
The court issued the notice to the respondent. Therefore, the court stated that in the meanwhile, there shall be an interim stay on the directions issued by the trial court through the October 2022 order and upheld by the Allahabad High Court
in July 2023.
