Supreme Court: Interim Relief Granted To Arunachal Pradesh BJP MLA Dasanglu Pul Whose Election Was Set Aside By High Court

The Supreme Court in the case Dasanglu Pul vs Lupalam Kri observed and has granted interim relief to the to BJP MLA from Arunachal Pradesh Dasanglu Pul, thus, whose election to the assembly was being declared void by the Gauhati High Court on April 25, 2023.
In the present case, the Supreme Court ordered that no bye-election should be held in the constituency represented by her in the meantime, the court while posting Pul’s appeal for hearing on September 6, 2023.
The bench comprising of Justice AS Bopanna and Justice Sanjay Karol in the case observed and has stated that the Pul will be entitled to all privileges as Member of the Legislative Assembly and will also be allowed to participate in all the proceedings in the House and in the Committees and she would not be entitled to cast her vote on the Floor of the House and in any of the Committees where she participates in the capacity as a Member of the Legislative Assembly.
Therefore, Dasanglu Pul, who being the widow of former Chief Minister Kalikho Pul, was elected in the year 2019 from the Hayuliang Assembly constituency. Thus, the High Court in its verdict stated on an election petition filed by her opponent in the election Lupalam Kri alleging that she had not disclosed six properties of her late husband in the election nomination form. Subsequently, the said court invalidated her election on the ground that she had not presented her nomination paper in accordance with Section 33 of the Representation of the People Act, 1951 and that the same was liable to be rejected by the said court.
