Delhi High Court: Seeking NIA’s Response On Bail Plea Of Two Kashmiri Youth In UAPA Case

The Delhi High Court in the case observed and seek response of the National Investigation Agency on the bail petition moved by two Kashmiris in connection with a UAPA case which is registered in the year 2021.

The Division bench comprising of Justice Siddharth Mridul and Justice Talwant Singh in the case observed and has issued a notice in an appeal moved by one Haris Nisar Langoo and Zamin Adil against the order of Trial Court wherein it denied the bail on March 03. Therefore, both Langoo and Adil were being arrested on 22.10.2021.

In the present case, an FIR was being registered in October 2021 under Section 18, Section 18A, Section 18B, Section 20, Section 38 and Section 39 of the UAPA and Section 120B, Section 121A, Section 122 and Section 123 of the Indian Penal Code, 1860.
Therefore, in the case the FIR was being registered by NIA on the basis of an order of the Ministry of Home Affairs, the CTR Division wherein it is alleged that the cadres of various terrorist organizations namely Lashkar-e-Toiba, LeT, Jaish-e- Mohammed JeM, Hizab-ul-Mujahideen, HM, Al Badr and their affiliates are active in Jammu And Kashmir and other places.

It being the case of NIA that Langoo knowingly entered into a conspiracy hatched by terrorists and other co-accused persons in order to commit multiple attacks in the Kashmir valley.
Therefore, the said court also accused him of actively working for the ideology of the terrorist organizations as per the directions of various terrorist outfits in order to create unrest in the Kashmir valley and also the other parts of the country.
It has also been alleged by the agency against Adil that incriminating material was recovered from him during the raids and searches. Thus, it alleged that Adil himself disclosed that he was well connected with network of terrorist organisations and has provided necessary support to them.

Further, the Trial Court in the month of January granted bail to the Co-accused, who being a 25-year-old Kashmir based photojournalist Mohd Manan Dar.
Accordingly, the court listed the matter to be next heard on July 18, 2023.
The counsels, Advocates Tara Narula, Tamanna Pankaj and Priya Vats represented the appellants.
