Delhi High Court: Directed Centre To Take Decision In 8 Weeks On Establishing Separate Complex For NCLT, NCLAT

The Delhi High Court in the case NCLT Bar Association Thr Its Secretary General v. Union of India And Ors observed and has directed the Central Government for taking a decision within eight weeks in respect of the matter related to establishing of a separate complex for NCLT, National Company Law Tribunal and NCLAT, National Company Law Appellate Tribunal.
The division bench comprising of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad observed and passed an order in the plea filled in the year 2018 by bar associations of the NCLT and NCLAT tribunals as grievance were raised about several deficiencies at the existing premises.
Before the court, on October 19, the counsel appearing for the petitioners submitted that the Bar has been handed over a list of various plots and other buildings which are presently being under construction for developing a complex for housing the two tribunals.
Bharathi Raju, Senior Panel counsel appearing for the Centre submitted that the list may be handed over to her so as to enable her to forward the same to the authorities concerned for taking the decision.
The court ordered that, let the same may be done, the Respondents are directed to positively take a decision within eight weeks, after receiving the aforesaid list.
In the present matter, while perusing the status report filled, it was also directed by the court to consider the allotment of the entire floor of the building, presently where the NCLT is operating from to the tribunal and noting that the space is now available.
The Court stated that the Respondents should also comply with the undertakings given by them in the Status Report.
In April, the court directed maintenance of status quo with regard to the renovation, occupation or construction of the space being vacated by the Ministry of New and Renewable Energy in the building where the NCLT tribunal is located.
Accordingly, the court listed the matter on February 3, 2023.
