The Kerala High Court in the case XXX v. State of Kerala observed and has quashed the proceedings against the controversial activist Rehana Fathima before the lower court in the case which relates to the circulation of a video wherein the video showed her children painting on her semi-nude body.
The bench headed by Justice Kauser Edappagath in its order stated that the allegations made against Fathima was that she had asked her two minor children, a boy and a girl of the age 14 and age 8 years respectively, in order to paint her semi-nude body, the video of which was thereafter circulated.
Before the court, it has also been contended by her that the said act was meant to impart sex education to her children and rid the stigma about nudity.
The said case was being registered against Fathima as stated under section 13, section 14 and section 15 of the Protection of Children from Sexual Offences Act, 2012 and Section 67B (d) of the Information Technology Act, 2000 and Section 75 of the Juvenile Justice ( the Care and Protection of Children) Act, 2015.
Earlier, the High Court in the case observed and has dismissed the application of her wherein seeking anticipatory bail in the case and the court observed that while the accused was free to give sex education to her children in the manner she wished within the four walls of her house and by publicising the video, as the video showing children doing the painting on her naked body, she had, prima facie, attracted the offences which relates to the obscene representation of children.
The bench of Justice PV Kunhikrishnan in its order stated that the petitioner in the case feels that she should teach sex education to her children and she also ask her children to paint on her naked body and then uploading the same in social media and the said court is not in the position to agree with the petitioner that she should teach sex education to her children in this manner.
