The Kerala High Court in the case X v. State of Kerala observed and has granted interim to a minor, who is being accused of murder among other offences for enabling him to visit his ailing mother and to consult his lawyer. The bench headed by Justice P.V Kunhikrishnan in the case observed and has noted that the petitioner is already serving a prison sentence in another case, while the court granted one week on interim bail to him.
In the present case, the petitioner being the accused before the special court under the POCSO Act cases and are in judicial custody since March 2019. The petitioner has been charge sheeted in a case under Sections 294(b) i.e., for the obscene songs in public, Section 326, for voluntarily causing grievous hurt with dangerous weapons, Section 302, the criminal intimidation, section 302, murder of Indian Penal Code, 1860 and Section 75 of the Juvenile Justice Act among others.
The counsel, Advocate V. Vijitha appearing for the petitioner submitted before the court that the bail application was filed so that the petitioner could meet his mother suffering from a serious illness and his lawyer for the conduct of the case. Public Prosecutor Maya M appeared for the State in the matter.
The court stated that the petitioner in the case has the ability for approaching the court with the bail application, thus, the High Court in the case permitted him to seek interim bail before the lower court.
The petitioner in the plea also submitted that he would be satisfied if an interim bail which is granted for the period of one week.
Accordingly, the trial court dismissed the bail application.
