A Delhi court recently halted the appearance of gangster Deepak Pahal, also known as Boxer, before a court in Karnal, Haryana. This stay was in response to his request regarding the production warrant issued by the Karnal court in a criminal case.
On December 29, Duty Magistrate Gita at Tis Hazari Court suspended the warrant compelling Deepak Boxer’s appearance in the Karnal Court until the decision on his application under Section 269 Cr.PC. The court instructed the authorities at Mandoli jail not to produce Deepak Boxer in the court outside Delhi until the hearing of his application scheduled for January 6, 2024.
Prior to issuing the order, the court reviewed a report filed by the Additional Superintendent regarding a case registered by the Delhi Crime Branch, where Deepak is currently in judicial custody.
Advocate Virender Mual, representing Deepak Boxer, filed an application seeking to halt the production warrant until the disposal of his plea under Section 269 Cr.PC. Earlier, Deepak Boxer, through advocate Virender Mual, had filed an application invoking Section 269 CrPC, urging the jail authorities not to produce him outside Delhi.
Deepak Boxer invoked Section 269 CrPC to prevent the prison authorities from executing orders in specific circumstances. He sought directions from the concerned jail authorities to comply with Section 269 CrPC regarding his appearance before trial courts in other states, citing concerns about being a high-risk prisoner and the potential risk to his life during transportation. This action was requested in the interest of justice and fairness, noting multiple pending cases against him, including one under the MCOCA act.
