Delhi HC To Hear Arvind Kejriwal’s Plea Against CBI Arrest Tomorrow

The Delhi High Court will hear Arvind Kejriwal’s plea against arrest by the CBI on Tuesday.

A panel led by Justice Neena Bansal Krishna will adjudicate on the Delhi Chief Minister’s petition.

Arvind Kejriwal filed the petition today. Earlier in March, he was arrested by the Enforcement Directorate in connection with the Delhi excise policy case, and subsequently in June, the CBI also arrested him.

The CBI’s action followed his bail in a related money laundering case granted by a local court. Kejriwal, the national convenor of the Aam Aadmi Party (AAP), has contested a June 26 court order that remanded him in CBI custody for three days.

On June 29, he was further remanded to judicial custody until July 12 in the corruption case, with the court citing ongoing investigations and his alleged role as a key conspirator.

The CBI alleged that Arvind Kejriwal did not cooperate with the investigative team and provided evasive responses during his three-day custody.

They also expressed concerns that Kejriwal could influence witnesses related to the Delhi excise policy case.

On June 26, the trial court declined to rule his arrest by the CBI as unlawful.

The trial judge said the timing of the arrest may be “circumspect but it is not the clear criterion for declaring an arrest illegal”.

“Investigation is the prerogative of the investigating agency, however, there are certain safeguards provided in the law and at this stage, on the material on record, it cannot be said that the arrest is illegal. The agency, however, should not be overzealous,” the trial court had said.

Arvind Kejriwal and other AAP leaders have been accused by agencies of allegedly receiving ₹100 crore as kickbacks in exchange for implementing a liquor policy that favored certain politicians and businessmen. The policy was revoked soon after the Delhi Lieutenant Governor recommended an investigation into irregularities in license issuance.
