A Los Angeles judge dismissed four employment discrimination claims against Vin Diesel, yet the more serious sexual battery and wrongful termination allegations remain active. The ongoing lawsuit is now moving forward under a recent California law reviving old assault claims.

A Los Angeles judge has dismissed four employment discrimination claims against actor Vin Diesel, but there are serious allegations of sexual battery and wrongful termination brought by his former assistant that are ongoing.

The lawsuit was filed in 2023 by Asta Jonasson, claiming that in 2010, Diesel sexually assaulted her by “pinning her against a wall in a hotel suite and masturbating in front of her.” While the incident dates back over a decade, a new California law signed in 2023—the Sexual Abuse and Cover-Up Accountability Act which allows certain old sexual assault claims to be revived.

Despite this, the Los Angeles County Superior Court Judge Daniel M. Crowley ruled that Jonasson’s four claims under California’s Fair Employment and Housing Act (FEHA) are invalid because she failed to file an administrative complaint with the state Civil Rights Department within one year of the alleged incident, which is required by law.

Judge Crowley stated, “Plaintiff’s FEHA claims are time-barred because she failed to timely exhaust her administrative remedies.”

This dismissal only applies to the FEHA-related claims including employment discrimination. Other claims such as sexual battery, wrongful termination, retaliation, negligent supervision, and infliction of emotional distress are all unaffected and will proceed in court.
Vin Diesel’s attorney has denied all allegations and has called the claims as frivolous. The legal battle continues as both parties prepare for further court proceedings that could reveal more about the case and Diesel’s conduct.
