The encounter of the accused in Hyderabad’s Disha rape and murder case was “staged”, stated the Sirpurkar Commission report submitted before the Supreme Court. It was also mentioned in the report the accused in the Hyderabad veterinarian’s gang-rape and murder were “deliberately fired upon with an intent to cause their death.” Following this the Supreme Court on Friday asked the Telangana High Court to take action on the commission’s report.
The Sirpurkar Commission has recommended action against the police officers. The commission said, in our opinion, the accused were shot deliberately so that they may die. There should be a criminal case against the police officers involved in this encounter.
The Sirpurkar Commission was constituted by the court to investigate the encounter. Sirpurkar Commission comprising Justice V.S. Sirpurkar, a former Supreme Court judge, along with Justice Rekha Baldota, a former judge of the Bombay High Court, and Karthikeyan, former director of CBI, investigated the matter and submitted the report.
In November 2019, a 27-year-old female veterinary doctor was raped in Hyderabad, Telangana. After that she was murdered. The body of the female doctor was found in a burnt condition under a bridge in Shadnagar. Hyderabad Police had arrested four people in this case. After this there was an encounter of all four of them. However, the police claimed that when the accused were taken to the crime scene, they tried to escape, after which the four were killed in an encounter.
Two petitions were filed in the Supreme Court and an independent investigation was sought against the police officers concerned in the encounter case. The hearing of the case was held in the Supreme Court on Friday. During this, Telangana government’s lawyer Shyam Divan demanded that the report of the Sirpurkar Commission should be kept sealed, which was refused by the court.
Chief Justice of India, N.V. Ramanna said that there was nothing confidential in the report. Some people have been found guilty. What to do with them, it is for the state government to decide. Diwan said that after seeing the report, the court should close the seal again.
“When the report does not reach the petitioners, then what will be the purpose of conducting an inquiry?” the CJI asked.
The SC-appointed committee recommended that the 10 police officers be tried for murder in killing of the four accused. The commission said that the police version that the accused snatched a pistol and tried to escape was not backed by evidence.
