In the whole clean-chit report case by the CBI of Anil Deshmukh, a Delhi Court on Thursday granted two days’ CBI custody of former Maharashtra Home Minister Anil Deshmukh’s lawyer, Anand Daga, and CBI Sub-Inspector Abhishek Tiwari. Both were arrested yesterday from Mumbai and brought to Delhi on the allegations of leaking sensitive information, thereby subverting investigation into the corruption case.

The CBI Wednesday detained the lawyer of former Maharashtra Home Minister Anil Deshmukh, questioned the NCP leader’s son-in-law and arrested a sub-inspector of the agency in connection with the alleged leak of an official report on its investigation into allegations of policemen being coerced by Deshmukh to collect bribes on his behalf. The agency let Deshmukh’s son-in-law, Gaurav Chaturvedi,

go after a few hours, but detained lawyer Anand Daga, who was travelling with him when their car was intercepted by the CBI at Worli Seaface at around 7 pm. Around 2.00 pm, Abhishek Tiwari, sub-inspector of CBI, and lawyer Anand Daga were brought to Rouse avenue court. It was Special Judge CBI Vimal Kumar Yadav who heard the matter. Advocate Tanveer Ahmed Mir represented lawyer Anand Daga, while no-one appeared for sub-inspector Tiwari. During proceedings, Advocate Mir demanded FIR, but CBI prosecutor said it’s confidential and there was some secret information so they can’t share, to which Mir said it’s a public document. “I believe they put the FIR on the website. If they haven’t, then they are in clear violation of the Supreme Court order.”

The court later asked CBI to at least give the defense counsel the FIR to read and asked them to read allegations. CBI sought custody for the two for seven days and submitted, “Abhishek Tiwari (was in a) conspiracy with accused persons, case-related documents leaked and got illegal gratification in return. It has been happening at regular intervals. Tiwari and Daga were arrested last night.” Later Advocate Mir stressed on a copy of the arrest memo. The arrested sub-inspector of CBI submitted in the court that he was a part of the preliminary inquiry. Abhishek Tiwari’s version is that in the Sachin Waze extortion racket, he was being pressurised to change the colour of the case so that it would be against Anil Deshmukh, but he did not give in to it, so now he is being victimised.

Meanwhile Daga’s lawyer Tanvir Mir while speaking with media said, “The CBI made allegations of collusion and illegal gratification, and has pursuant to arrest seized their phones.CBI has not given any details about FIR or reason of arrest. Given that no reason was given, it is illegal detention. We have strongly opposed any custody.” Remand application of CBI, alleging that Abhishek Tiwari entered into criminal conspiracy with Anand Daga, and disclosed case sensitive and confidential documents to him, who is an unauthorized person, for the purpose of subverting investigation of CBI in lieu of undue advantage and illegal gratification to himself. Daga’s lawyer is likely to file a bail application in the matter on Friday.
