The Calcutta High Court in the case observed and has reassigned the case which relates to the Primary Teachers’ Recruitment Scam in West Bengal, to Justice Amrita Sinha.
The notification issued by the High Court stated that the Writ Petitions, all application filed in the writ petitions and any further application’s or that may be filed which includes Review Applications are assigned to the Hon’ble Justice Amrita Sinha.
Therefore, the Supreme Court in the case directed the Acting Chief Justice of Calcutta High Court to reassign the matter to another judge on April 28, 2023.
The bench headed by Justice Abhijit Gangopadhyay was earlier hearing the matter, wherein the court directed the CBI and the ED to question TMC national general secretary Abhishek Banerjee in the case. Thus, it has also been directed by the High Court on April 17 to put a stay on all actions which are against Banerjee in pursuance of the directions being passed by Justice Gangopadhyay. Subsequently, the Supreme Court had also taken the exception to Justice Gangopadhyay’s interview with ABP Ananda wherein it has allegedly been spoken against Banerjee.
Further, the court in the case remarked that the judges have no business granting interviews on matters which are pending, and had seek for the clarification as to whether the purported statements were being made by the single judge or not. Therefore, the Registrar General of the High Court was directed for filing an affidavit after verifying the matter with the judge.
Therefore, it has also been directed by the Apex Court to the high court Chief Justice in order to reassign the matter, further, it has been directed by Justice Gangopadhyay that the Secretary General of the Supreme Court in order to provide to him by midnight, the transcription copy of the interview, given by him in the media which is being placed before the Supreme Court.
Accordingly, the Supreme Court stayed the order of Justice Gangopadhyay, wherein citing Judicial Discipline.
