In a significant move, Vishnu Jain, the advocate for the Hindu party for the Mathura Krishna Janmabhoomi case, has written a letter to the Chief Justice of the Allahabad High Court, requesting him to establish a full bench.
In a comprehensive three-page letter, Advocate Vishnu Jain makes specific reference to the Supreme Court’s order dated July 21, 2023, as well as earlier rulings of the Allahabad High Court from May 26, 2023.
It is worth noting that on May 26, 2023, the Allahabad High Court issued an order instructing the transfer of all petitions pertaining to the Mathura Krishna Janmabhoomi case from the Mathura District Court to the High Court. However, up to the present moment, a bench has not been constituted for the case within the Allahabad High Court.
The Shahi Eidgah Committee of Mathura had voiced its objection to this directive by the Allahabad High Court and subsequently contested the decision in the Supreme Court while seeking an injunction.
Despite the objections raised by the Muslim side, Justices Sanjay Kishan Kaul and Vipin Dhulia, presiding over the case, decided that it would be appropriate for the Registrar of the Allahabad High Court to provide a list of the cases being requested for joint consideration. Furthermore, the Supreme Court appended a concluding remark to its order, indicating a certain degree of vagueness in the original directive.
Previously, during the course of the hearings, the Supreme Court had also inquired orally from the Muslim side whether they had any objections if the Allahabad High Court sought to consolidate and adjudicate all cases presently pending in the Mathura District Court.
However, in the wake of Advocate Vishnu Jain’s recent letter, the Mathura Krishna Janmabhoomi case has once again sparked significant interest and debate.
