The Supreme Court directs 5 social media influencers, including Samay Raina, to issue public apologies for mocking persons with disabilities

The bench observed that “Freedom of speech doesn’t cover commercial speech that hurts sentiments of a community.”

Influencers must display apologies on YouTube channels & podcasts and file affidavits confirming compliance

The court said it may impose penalties on influencers for targeting disabled persons

Centre asked to draft social media rules to curb offensive content against disabled, women, children & seniors

“Humor is fine until it breaches sensibility. Commercialized speech cannot hurt community dignity”

Justice Surya Kant said, “There should be a balance of rights and duties. Article 21 must prevail over Article 19.”
